BMS has Federal Public Health Service (PHS) status and is granted medical malpractice liability protection through the Federal Tort Claims Act (FTCA). Under the Act, the BMS Family Health and Wellness Centers and its covered individuals are considered Federal employees and are immune from lawsuits, with the Federal government acting as the primary insurer.
